Terms and Conditions

Our Terms and Conditions (hereinafter, "T&C") constitute a legally binding agreement between BeQuit (hereinafter, "Us", "We" or "Our") and you (hereinafter, "User," "Users," "your," or "yours"). Your use of our App shall be governed by the following T&C. BeQuit is a comprehensive smoking cessation application designed to help users quit smoking through personalized health tracking, gamified challenges, community support, and real-time progress monitoring.

Subscription Services and Payments

BeQuit offers subscription-based premium features through Apple's App Store:

Free Trial:

New subscribers receive a 3-day free trial of the app. You may cancel at any time during the trial period without charge.

Subscription Plans:

We offer monthly and annual subscription plans. Current pricing is displayed in the App Store and may vary by region.

Auto-Renewal:

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation:

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing cycle.

Refunds:

Refund requests are handled by Apple according to their refund policy. We do not process refunds directly.

Feature Access:

App features are only available during active subscription periods. Upon cancellation, access to the app will be revoked at the end of the billing period.

BeQuit Subscription Features Include:

  • Advanced health analytics and insights
  • Community groups and social features
  • Custom challenges and achievements
  • Smart notifications and reminders
  • Detailed progress reports
  • Friend invitations and social challenges
  • Premium support

Age Requirements

As BeQuit is a smoking cessation application, you must be of legal smoking age in your jurisdiction (typically 18 or 21 years old) to use our App. This requirement exists because:

  • Our App is specifically designed for individuals who are legally old enough to smoke and are seeking to quit
  • We comply with all applicable laws regarding age restrictions for smoking-related services
  • Content and features are designed for adult users who understand the health implications of smoking
  • Our community features and challenges are intended for mature users

We reserve the right to suspend and cancel your account unilaterally and without notice if we have reasonable doubt that you do not meet the legal age requirement in your jurisdiction. By using our App, you confirm that you are of legal smoking age in your jurisdiction.

Registration and Account

You agree to provide accurate information regarding your email address, age verification, smoking history, and any other information requested during registration for our App. This information is essential for providing personalized quit smoking support and calculating accurate health improvements. Should any of your details change, you shall immediately update your data in the app settings or notify us via email at office@invsion.at.

You agree to receive notifications through the app and via email for security purposes, health milestone celebrations, challenge updates, and motivational support as part of your quit smoking journey.

App Features and Health Data

BeQuit provides various features including but not limited to: real-time smoke-free tracking, health milestone monitoring, money saved calculations, XP and achievement systems, social challenges, community support, and home screen widgets. You understand that:

  • Health calculations are based on scientific research but are estimates and not medical advice
  • The app is a supportive tool and does not replace professional medical guidance
  • Your progress data helps improve the accuracy of health milestone tracking
  • Social features are optional and you control what information you share

User-Generated Content

When using BeQuit's social features, you may submit content including posts, comments, and messages. You retain ownership of your content but grant us a non-exclusive license to use, display, and distribute your content within the app for the purpose of providing social features to all users.

You are solely responsible for all content you submit and agree that it will not:

  • Violate any laws or regulations
  • Infringe upon others' intellectual property rights
  • Contain harmful, abusive, or inappropriate material
  • Promote smoking or undermine quit attempts
  • Include personal information of other users without consent

We reserve the right to remove any content that violates these terms without notice.

Account Termination

You may terminate your account at any time by contacting us at office@invsion.at or through the app settings. We may terminate your account if you violate these terms.

Upon termination:

  • Your subscription will remain active until the end of the current billing period
  • You will lose access to the app immediately upon subscription expiration
  • Your account data may be retained for a reasonable period as outlined in our Privacy Policy
  • Community content you've shared may remain visible to other users

Devices and Software

You may need to provide certain devices, software, and data connections to use our App, which we otherwise do not supply. In order to use BeQuit, you consent to manually or automatically download and install updates to our App. You also consent to our sending you motivational notifications, health milestone alerts, and challenge updates via our App from time to time, as necessary to support your quit smoking journey and keep our App functional.

Apple App Store End User License Agreement (EULA)

If you download BeQuit from the Apple App Store, the following additional terms apply:

1. Agreement Parties:

You acknowledge that this EULA is concluded between you and Invsion OG only, and not with Apple. Invsion OG, not Apple, is solely responsible for BeQuit and its content. This EULA does not conflict with the Apple Media Services Terms and Conditions.

2. License Scope:

The license granted to you is limited to a non-transferable license to use BeQuit on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. BeQuit may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

3. Maintenance and Support:

Invsion OG is solely responsible for providing any maintenance and support services for BeQuit. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services for BeQuit.

4. Warranty:

Invsion OG is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of BeQuit to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for BeQuit to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to BeQuit, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Invsion OG's sole responsibility.

5. Product Claims:

You acknowledge that Invsion OG, not Apple, is responsible for addressing any claims relating to BeQuit or your possession and/or use of BeQuit, including but not limited to: (i) product liability claims; (ii) any claim that BeQuit fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA does not limit Invsion OG's liability to you beyond what is permitted by applicable law.

6. Intellectual Property Rights:

You acknowledge that, in the event of any third party claim that BeQuit or your possession and use of BeQuit infringes that third party's intellectual property rights, Invsion OG, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

7. Legal Compliance:

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third Party Terms of Agreement:

You must comply with applicable third party terms of agreement when using BeQuit, including but not limited to your wireless data service agreement and any other applicable terms and conditions.

9. Third Party Beneficiary:

You acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof.

Intellectual Property

All material and services available and/or provided by our App, its affiliates, employees, licensors or other commercial partners are the property of our App or other parties that have licensed their material or provided services to us. Such material and services are duly protected by registered and unregistered copyright, trademarks, trade secrets, design and such other intellectual property laws.

Privacy Policy

Please review our Privacy Policy at bequit.app/privacy-policy. By using our App, you agree to be bound by our Privacy Policy, which is incorporated into these T&C. Your quit smoking data is handled with the utmost care and security.

Community Guidelines

BeQuit includes social features such as friend connections, group challenges, and community support. When using these features, you agree to:

  • Provide encouragement and support to other users on their quit smoking journey
  • Respect others' privacy and not share personal information without consent
  • Avoid harmful, offensive, or inappropriate content in any communications
  • Not use the platform to promote smoking or undermine others' quit attempts
  • Report any abusive behavior or content to our support team

Limitation of Liability

WE WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR 100% OF THE SUBSCRIPTION FEES PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

BeQuit is a supportive tool for smoking cessation and should not be considered medical advice. Always consult with healthcare professionals for medical guidance related to smoking cessation.

Indemnification

You agree to defend, indemnify, and hold harmless BeQuit from and against all liabilities, damages, losses, and expenses of any kind (including reasonable legal fees and costs) relating to, arising out of, or in any way in connection with any of the following: (a) your access to or use of our Services; (b) your breach or alleged breach of our Terms; (c) any misrepresentation made by you; or (d) your use of social features and interactions with other users.

Dispute Resolution

We are committed to resolving any disputes or concerns you may have about BeQuit. For inquiries or complaints, contact us at office@invsion.at. We will work diligently to address your concerns and ensure your quit smoking journey is supported.

For unresolved privacy-related complaints, you may contact the appropriate data protection authority in your jurisdiction.

Amendments

We reserve the right to modify these terms at any time to reflect new features, legal requirements, or improvements to BeQuit. Changes shall be effective immediately for new users and after thirty (30) calendar days for existing users. You are responsible for maintaining your current contact information in your account settings. We will notify you of significant changes via app notification or email.
